These Terms and Conditions (“Terms”) apply to the Aasha app, website and related services, including Aashatype Cards (together, the “Service”), provided by Aasha Technologies (“Aasha”, “we”, “us”) as a commercial service. They apply to two kinds of users: candidates who create a profile and Aashatype Card (“Candidates”), and businesses that have signed an agreement with Aasha to view candidate cards (“Signed Employers”).
1. Agreement to Terms
By downloading, accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. Unauthorized copying or modification of the Service, any part of it, or our trademarks is prohibited. You may not extract the source code of the Service or create derivative versions of it. All trademarks, copyrights, database rights and other intellectual property rights in the Service, including the Aashatype methodology, card designs and design system, remain the property of Aasha.
2. Eligibility and Minimum Age
To use the Service as a Candidate you must be at least 16 years old and legally permitted to work in the state or country where you are seeking work. Candidates aged 16 and 17 may use the Service to find part-time and summer jobs, as allowed under applicable child labor laws.
The Service is not intended for anyone under 16. We do not knowingly collect personal information from anyone under 16. If we learn that we have, we will delete the account and its data, and we will not share it with any employer.
Signed Employers must be legally registered businesses and must use the Service through an authorized representative who is at least 18 years old.
3. Aashatype Cards
When you complete the Aasha survey, we create an Aashatype Card from your answers. A card may include your name, profile photo (if you provide one), Aashatype archetype, trait scores and charts, motivations, and the Bring and Need statements you choose.
Your Aashatype Card is a profile tool, not a professional psychological assessment, a guarantee of job performance or a reference. Results reflect your answers at the time you gave them.
We review each card before it is sent to you. You may ask us to correct details that are factually wrong, such as your name or photo.
4. Sharing Your Card with Signed Employers
With your consent, we share your Aashatype Card, including your name, photo and the contact details you choose to include, with Signed Employers who are looking for candidates. You give this consent when you create your card and confirm that you want it shared.
You may withdraw your consent at any time in your account settings or by emailing support@aasha.com. After withdrawal we will stop sharing your card with new employers. We will also ask Signed Employers who already received it to delete it, as their agreement with us requires.
Aasha does not decide whether any employer hires you, and does not guarantee any interview, job offer or outcome.
5. Your Content and Photos
You are responsible for the information and photos you submit. You confirm that they are accurate, that any photo shows you, and that you have the right to submit it. Photos must not contain nudity, offensive material or other people without their permission.
You keep ownership of your content. You grant Aasha a non-exclusive, royalty-free licence to use, store, format and display your content to create your Aashatype Card and to share it as described in these Terms and our Privacy Policy. This licence ends when you delete your content or account, except for copies a Signed Employer already lawfully received and backup copies kept for a limited time.
We do not use your photo for facial recognition or to identify you by biometric means.
6. Rules for Signed Employers
Signed Employers must also follow their written agreement with Aasha. In particular, Signed Employers must:
- use candidate cards only to evaluate candidates for genuine job opportunities;
- not sell, publish or pass candidate cards to anyone outside their hiring team;
- not use cards or photos to discriminate on the basis of race, color, religion, sex, sexual orientation, gender identity, national origin, age, disability or any other characteristic protected by law;
- not use an Aashatype Card as the sole basis for a hiring decision;
- keep candidate data secure and delete it when Aasha or the candidate asks, or when it is no longer needed for hiring;
- comply with all employment, anti-discrimination, child labor and privacy laws that apply to them.
We may suspend or end an employer’s access if they break these rules.
7. Service Modifications and Charges
We aim to keep the Service useful and efficient. We may change the Service or charge for it at any time. We will clearly tell you about any charges before they apply to you.
8. Data Security and Device Responsibility
The Service stores and processes personal data you provide so we can deliver it, as described in our Privacy Policy. You are responsible for keeping your device and account access secure. We strongly advise against jailbreaking or rooting your phone, which can expose it to malware, weaken its security, and stop the Service from working properly.
9. Connectivity and Network Charges
Some features need an internet connection, by Wi-Fi or mobile data. We are not responsible if the Service does not work fully without a connection or because you have used up your data allowance. Your mobile provider’s terms still apply, and you are responsible for any data or roaming charges. If you are not the bill payer for your device, you confirm you have the bill payer’s permission.
You are also responsible for keeping your device charged. We are not responsible if you cannot use the Service because your device has no power.
10. Accuracy and Updates
We work to keep the Service accurate and up to date, but parts of it rely on information from third parties and from users themselves. We are not liable for any loss, direct or indirect, that results from relying entirely on that information.
We may update the Service, and you may need to install updates to keep using it. We do not guarantee that the Service will always be compatible with your device or operating system version.
11. Disclaimers and Limitation of Liability
The Service is provided “as is” and “as available”. To the fullest extent the law allows, Aasha disclaims all warranties, express or implied. Aasha is not responsible for the hiring decisions or conduct of Signed Employers or Candidates.
To the fullest extent the law allows, Aasha will not be liable for indirect, incidental, special or consequential damages. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim, or US $100 if you paid nothing.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or end the Service, or your access, at any time, including if you break these Terms. When access ends, the rights granted to you under these Terms end, and you must stop using the Service and delete the app from your device if needed. Sections that by their nature should survive, such as intellectual property, disclaimers and limitation of liability, continue to apply.
13. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Nothing in these Terms limits rights you have under the consumer or privacy laws of the state where you live.
14. Changes to These Terms
We may update these Terms from time to time. We will post the new version on this page with a new effective date. If a change materially affects how we share your Aashatype Card, we will notify you directly and ask for your consent again where the law requires it.
15. Contact Us
